Terms of Service

1. Who We Are

Fruity is a drag event discovery and booking platform operated by Will Tan, based in Amsterdam, the Netherlands. "We", "us", and "our" refer to Fruity/Will Tan. "You" refers to any individual or entity using the platform.

Fruity connects drag fans with performers and events. We are not an employer, agent, or manager of any performer listed on the platform. Performers are independent professionals responsible for their own commitments and conduct.

2. Your Account

To access certain features (such as creating a performer profile or managing events), you need an account. When creating an account, you agree to:

• Provide accurate and complete information
• Keep your account information up to date
• Maintain the security of your account
• Not share your login credentials with others
• Notify us immediately of any unauthorised access at will@getfruity.io

You are solely responsible for all activity under your account. We may suspend or disable accounts we believe have been compromised or used in violation of these Terms.

3. Minimum Age

You must be at least 16 years old to use Fruity. By using the platform, you represent that you meet this requirement. If you are under 18, you may only use Fruity under the supervision of a parent or legal guardian.

4. Performer Profiles and User Content

If you create a performer profile, you are responsible for all content you post — including photos, biographies, and other information. You represent and warrant that:

• You own or have the right to use all content you post
• Your content does not infringe any third party's intellectual property, privacy, or other rights
• Your content is accurate and not misleading
• Your content complies with these Terms and applicable law

By posting content on Fruity, you grant us a worldwide, royalty-free, non-exclusive licence to use, display, and distribute that content solely for the purpose of operating and promoting the platform.

We do not claim ownership of your content. You retain all rights you have in it.

We reserve the right to remove content that violates these Terms, without notice.

5. Booking Enquiries

Fruity provides a form for submitting booking enquiries to performers. Submitting an enquiry is not a binding contract between you and Fruity, and does not guarantee a booking. Bookings are agreements between you and the performer directly. Fruity is not a party to those agreements and is not responsible for their outcome.

Performers are solely responsible for honouring commitments made through bookings and for the services they provide.

6. Tips and Payments

Fruity enables users to send tips to performers via Stripe. By sending a tip, you agree to Stripe's terms of service. Tips are processed directly by Stripe — we do not store your payment details.

All tips are final and non-refundable unless required by applicable law.

European Users: You have the right to withdraw from a digital transaction within 14 days, unless the service has already been fully performed. For tip transactions, by initiating the payment you agree that the transaction is completed immediately, and you waive your right of withdrawal to the extent permitted by applicable law.

7. Prohibited Uses

When using Fruity, you must not:

• Violate any applicable law or regulation
• Post content that is hateful, discriminatory, abusive, or harassing — particularly on the basis of gender identity, sexual orientation, race, religion, or disability
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity
• Post false, misleading, or fraudulent content
• Attempt to gain unauthorised access to any part of the platform or another user's account
• Use the platform to send spam or unsolicited messages
• Scrape, crawl, or extract data from the platform without our written consent
• Interfere with or disrupt the platform or its infrastructure
• Use the platform for any commercial purpose other than what it is designed for (e.g., to harvest performer contact details for off-platform solicitation)

Fruity is a queer-friendly space. Hateful or discriminatory behaviour will result in immediate account termination.

8. Intellectual Property

The Fruity platform — including its design, code, branding, and all content we create — is owned by Fruity/Will Tan and protected by applicable intellectual property laws. You may not copy, reproduce, or distribute any part of the platform without our written permission.

If you believe content on Fruity infringes your intellectual property rights, please contact us at will@getfruity.io with details of the alleged infringement.

9. Third-Party Services

Fruity uses third-party services including Stripe (payments), PostHog (analytics), Bytescale (image hosting), and Google Maps Platform (venue search). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of these third parties.

Links to external websites are provided for convenience only. We do not endorse and are not responsible for the content or practices of any third-party website.

10. Feedback

We welcome feedback, suggestions, and ideas. If you share them with us, you agree that we may use them freely without any obligation or compensation to you.

11. Changes to the Service

We may update, change, or discontinue any part of Fruity at any time. We will try to give reasonable notice of significant changes. Continued use of the platform after changes constitutes acceptance of the updated Terms.

We will notify you of material changes to these Terms by email or by a notice on the platform.

12. Termination

We may suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms or for any other reason at our discretion. You may delete your account at any time by contacting us at will@getfruity.io .

Upon termination, your right to use the platform ceases. Sections of these Terms that by their nature should survive termination will do so, including intellectual property, disclaimers, limitation of liability, and governing law.

13. Disclaimers

Fruity is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the platform will be uninterrupted, error-free, or free of harmful components. We do not warrant the accuracy, completeness, or usefulness of any content on the platform.

We are not responsible for the conduct, content, or services of any performer or user on the platform.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Fruity and Will Tan will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the platform, including but not limited to loss of profits, data, or goodwill, even if advised of the possibility of such damages.

Our total liability to you for any claim arising out of or relating to these Terms or your use of the platform will not exceed €100 or the amount you have paid us in the 12 months prior to the claim, whichever is greater.

European Users: Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under applicable law.

15. Indemnification

You agree to indemnify and hold harmless Fruity and Will Tan from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the platform, your content, or your violation of these Terms.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Netherlands. Any disputes will be subject to the exclusive jurisdiction of the courts of Amsterdam, the Netherlands.

European Users: If you are a consumer resident in the EU, you may also benefit from mandatory provisions of the consumer protection laws of your country of residence. Nothing in these Terms affects your rights as a consumer under applicable EU law.

17. Miscellaneous

If any part of these Terms is found to be unenforceable, the remaining parts will continue in full force. Our failure to enforce any part of these Terms is not a waiver of our right to do so later. These Terms constitute the entire agreement between you and Fruity regarding use of the platform.
